Prosecutors in two Florida counties have decided not to use breath-test results in about 100 current DUI cases in Sarasota and Manatee counties after learning about problems with the Intoxilyzer 8000. The Intoxilyzer 8000 is the same breath testing machine used in Kansas.

DUI charges based on flawed breath-test machines that reported impossible results.
About 40% of Florida's Intoxilyzer 8000s tested by the State were incorrectly measuring breath volumnes of 2-3 times normal human lung capacity. Makes you wonder how the machines in Kansas are working...
More problems with Intoxilyzer 8000
The people charged with a DUI in Kansas, and their lawyers and attorneys, will never know if and when, the Intoxilyzer 8000's began mismeasuring breath volume and giving false results. So, while it is a proven fact that 40% of the machines in Florida are wrong, and thousands of breath tests are in question, the thousands of people charged with DUI in Kansas will have to just hope the machine in which their entire future is placed was working as it is supposed to.
